Is CBD oil legal? And what about abroad?

Our CBD products fully comply with all legal requirements. Read all about when CBD is and is not legal and what it is like abroad.
The world of cannabis and hemp has – not entirely unjustifiably – quite a reputation as a “gray area” when it comes to legislation. Many cannabis products are illegal in the Netherlands, for example, even though they are tolerated. In other countries, on the other hand, they are legal or absolutely prohibited. Fortunately, legislation in the Netherlands and the EU regarding CBD is very simple: CBD oil is legal, provided the THC content is not too high. In this article you will discover all about the legislation regarding CBD in the Netherlands, Europe and beyond.

CBD legislation in the Netherlands

In the Netherlands, all products containing CBD are completely legal, provided the THC content in these products does not exceed 0.05%. All other ingredients found in CBD products are completely legal and deemed safe to use by our legislators.

So keep in mind that CBD oil (or hemp oil, cannabis oil or cannabis oil) that contains more than 0.05% THC is illegal. We therefore recommend that you always buy your CBD from licensed companies and choose good quality CBD. Definitely watch out with foreign webshops or hobby sellers, as there is a risk that they may be selling CBD that does not meet legal requirements!

Do you buy from Dutch Balance? Then you are guaranteed CBD products that never contain more than the legally permitted amount of THC. We can also prove this through test reports. This way you can be sure that the product you buy meets all legal requirements.

Is cannabis oil legal in Europe?

In Europe, the possession and use of CBD oil is completely legal in almost all countries, as long as the percentage of THC is lower than 0.2%. So in that respect, the rules surrounding CBD oil and cannabis oil in other countries in the EU are more lenient than in the Netherlands, which is also the immediate reason to watch out for importing CBD products into the Netherlands.

Keep in mind that the rules around CBD change regularly and sometimes the rules vary from country to country. So are you traveling by plane and want to take CBD with you? To be sure, always check the rules in your destination country before departure.

Cannabis oil is legal in the U.S., but beware

What applies to the European Union also applies to the United States: CBD oil is legal at the federal level (nationwide), as long as the percentage of THC does not exceed 0.3%. Thus, in most states, both the possession and use of CBD oil is fully permitted. Keep in mind, however, that individual states may have their own laws and regulations. Thus, we recommend that before traveling to the U.S. with CBD oil, check the state laws of where you are traveling.

Cannabis oil is illegal in many countries in Asia and Africa

CBD oil is also often legal in other countries in the Americas. This applies to both North, Central, and South America. However, be careful when traveling to countries in Asia, Africa, and Australia. In many of these countries, the possession and use of CBD is completely prohibited, as all products extracted from cannabis are classified as illegal. Are you unsure if CBD oil is legal in the country you are traveling to? If so, contact your travel or airline company to be sure, to avoid any problems!
