Is CBD oil legal? And how does that work abroad?

CBD legislation in the Netherlands

In the Netherlands all products with CBD are completely legal, provided the THC content in these products is no higher than 0.05%. All the other constituents that occur in CBD products have been found entirely legal and safe to use by our legislator.

So bear in mind that CBD oil (or hemp oil, cannabis oil) containing more than 0.05% THC is illegal. We therefore recommend always buying your CBD from recognised companies and choosing good quality CBD. Be especially careful with foreign webshops or hobby sellers, because there is a risk that they sell CBD that does not meet the legal requirements.

In Europe the possession and use of CBD oil is completely legal in virtually all countries, as long as the percentage of THC is lower than 0.2%. In that respect the rules around CBD oil and cannabis oil in other EU countries are more relaxed than in the Netherlands, which is also exactly why you should be careful about importing CBD products into the Netherlands.

Bear in mind that the rules around CBD change regularly and that the rules sometimes differ per country. So are you travelling by plane and would you like to take CBD with you? Then always check the rules in the country of destination before you leave, just to be sure.

What applies to the European Union also applies to the United States: CBD oil is legal at federal (national) level, as long as the percentage of THC does not exceed 0.3%. In most states both the possession and the use of CBD oil is therefore completely permitted. Bear in mind, however, that individual states can have their own laws and regulations. So we recommend consulting the state laws of the place you are travelling to before departing for the US with CBD oil.

Cannabis oil is illegal in many countries in Asia and Africa

In other countries on the American continent CBD oil is often legal too. This applies to North, Central and South America alike. Do take great care, though, when travelling to countries in Asia, Africa and Australia. In many of these countries the possession and use of CBD is completely prohibited, because all products extracted from cannabis are classified as illegal. Are you unsure whether CBD oil is legal in the country you are travelling to? Then contact your travel company or airline to be sure, and avoid problems.
